FIJI High Court jugde Justice Daniel Goundar today discharged a case of aggravated burglary and theft allowing the two accused persons to return to their homes.
The accused persons, Mesake Navatoga and Semi Rakai, appeared before Justice Goundar to answer to one count each of aggravated burglary and theft.
Director of Public Prosecution lawyer Sujata Lodhia filed for a noelle prosequi on the grounds that the State had issues relating to identification.
Justice Goundar asked Ms Lodhia if the stolen items were recovered, Ms Lodhia said there was no recovery of the stolen items.
The high court heard that Mr Navatoga had one previous conviction of theft and Ms Lodhia was unable to inform the court if there were pending cases against the two in other courts.
The two are alleged to have unlawfully entered a house in Toorak on April 14 this year and stole cash amounting to $3250 and assorted jewelry valued at $33,742.
